Delhi High Court Rejects Demand for Urgent Hearing

The Delhi High Court has refused an urgent hearing on a petition seeking demolition of a neighboring structure following the Satya Niketan building collapse in South Delhi. The court said the petition will be listed when its turn comes.

During the hearing, the Delhi court asked the petitioner why there was so much urgency in the matter and what was the technical information available in support of the petition. The Court also indicated that a case cannot be taken up for urgent hearing merely on the basis of general apprehensions.

A five-storey building collapsed in Satya Niketan on September 6. The building was being used as a paying guest accommodation for students and the accident has raised serious questions about building safety and illegal construction in the area.

Safety concerns raised about the neighboring building

Concerns were also raised about the safety of the surrounding structures after the collapse of the main building. In this sequence, action was started to demolish a building adjacent to the accident site.

The MCD had initiated controlled demolition of the neighbouring building in question. According to officials, this action was taken in view of security in view of the possibility of any further untoward incident in the area.

A petition was filed in the court regarding this action. The petitioner had sought immediate listing of the matter, but the High Court said that the matter would be heard as per the regular procedure for the time being.

The court sought technical information.

During the hearing, the High Court questioned the information provided in the petition and its urgency. The court wanted to know what kind of technical information the petitioner had regarding the neighbouring structure.

The court’s stand was that there must be a solid and technical basis for making a security claim regarding any structure. Immediate intervention of the court cannot be sought merely on the basis of apprehension.

Now the case will be heard as per the prescribed procedure. During this period, the concerned parties will have to present their side before the court on the basis of their arguments and available documents.

Building safety monitoring increased after the accident

Following the Satya Niketan accident, administrative and legal action has intensified regarding the safety of PGs, hostels, and other residential buildings in Delhi. The MCD has stressed on checking the maps, construction permissions, capacity and other safety standards of the buildings.

The investigation also looks into whether the buildings have been constructed as per the approved plan and whether they are being used as per the prescribed rules. Aspects related to fire safety and structural stability have also been made part of the investigation.

The Delhi government has also stressed on the need for regular structural audits and safety certification for buildings like PGs and hostels. Chief Minister Rekha Gupta has said that building security cannot be limited to mere paper formalities.

Hostel Collapse

The matter reached the Supreme Court.

After the Satya Niketan incident, the matter also reached the Supreme Court. The Supreme Court had refused to transfer the proceedings going on in the Delhi High Court to itself, saying that the proceedings in the case were progressing.

Wider questions were also raised before the apex court regarding the security of student residences and PG-hostels. The court also considered the possibility of safety guidelines for such accommodations across the country.

It is clear from this that the Satya Niketan accident is no longer limited to just one building. This has raised major questions about monitoring of student housing, unauthorised construction and building safety in the capital.

MCD’s actions and investigations are also under scrutiny.

Following the accident, the MCD has intensified its investigation into violations of building safety regulations. The officials are looking into whether the prescribed rules were followed in the construction and use of the concerned buildings or not.

Action has also been taken at the administrative level in the matter. According to reports, three MCD engineers have been suspended and the process of fixing responsibility for the accident is underway.

At the same time, legal action is also going on in the criminal case related to the accident. The process of production of the accused in the court and investigation as well as aspects related to building security are also being investigated.

Now eyes are set on a regular hearing.

After the Delhi High Court refused to list the petition immediately, the petition will now be heard under the regular process. The court’s stance at present is that the case should be taken forward as per the prescribed procedure.

After the Satya Niketan accident, the administration is continuing its action regarding the safety and potential risks of the neighboring buildings. In such a situation, further hearing in the court is being considered important.

At present, the main question is what conclusions the technical investigation of the officials gives regarding the safety of the surrounding buildings and what further arguments are put forward in the case before the court.
