Bihar Police Encounter Case: Supreme Court Rejects Petition Seeking CBI Investigation and Expert Committee, Find Out What the Court Said

The Bihar Police Encounter Case is once again in the news. The Supreme Court dismissed a petition seeking a Central Bureau of Investigation (CBI) probe and the formation of an independent expert committee in the Bihar police encounter case. The petition also sought a CBI inquiry as well as the formation of an independent expert committee. The petitioner argued that such a committee could conduct an impartial review of the entire incident and ensure independent assessment of the facts.

However, the Supreme Court did not accept this demand either. The court did not issue any direction for the formation of an expert committee. With this it became clear that at present no additional investigation committee will be formed in the case.

In legal matters, courts constitute expert committees only when they feel that the opinion of independent experts is necessary in a case of complex technical, scientific or special nature. The formation of such a committee is not mandatory in every case.

After this decision, the current investigation process will continue as before.

This decision of the Supreme Court in the Bihar Police encounter case is being considered important in many ways. The court made it clear that the decision on demands like CBI investigation and formation of expert committee will be taken only on the basis of available facts and legal standards. Legal experts say that the Supreme Court has already made it clear in several cases that CBI investigation is not a normal process. It is granted only in cases where the court clearly sees the need for an independent investigation.

According to experts, this decision can be considered as a judicial balance and in line with established legal principles, in which the court gives its decision according to the circumstances of each case.

After the Supreme Court dismissed the petition, there will be no CBI inquiry or expert committee formed in the Bihar Police encounter case at present. This means that the investigation of the case will proceed under the existing investigating agency and applicable legal process.

The investigating agencies will complete their investigation based on the available evidence, witness statements, forensic reports and other documents. After completion of the investigation, the concerned agency will submit its report as per the law and thereafter further judicial process will take place.

If any new evidence comes to light during the investigation in future or any new legal issue arises, the concerned parties may take appropriate legal remedies available under the law. However, at present, after the order of the Supreme Court, there has been no relief on the demand for CBI investigation.

Legal experts say that every order of the court in such cases is based on the available records and the facts presented at that time. Therefore, the basis for any future action will also be new facts and legal process.

At present this matter will proceed under judicial and investigation process. All parties will now be keeping an eye on the progress of the investigation and future official developments. This decision of the Supreme Court has currently put a stop to the demand for CBI investigation and expert committee, but the legal process of the case will continue.

The petition said that to ensure a fair investigation of the case, the investigation should be handed over to the CBI and an independent committee of experts should be formed to review the entire incident. The petitioner claimed that considering the gravity of the matter, an independent investigation was necessary.

The Supreme Court dismissed the petition after hearing the case. At present the court has not given any direction for CBI investigation or formation of expert committee. After this decision of the court, the current investigation process of the case will continue as before.
