X, the Elon Musk social network platform, has lost its legal battle with the Indian government from its content analysis order. The Karnatak High Court held that X is a foreign company and therefore cannot assert the constitutional law against India’s freedom of expression. Article 19, which protects freedom of expression, refers only to Indian citizens. Senior Judge M Nagaprashanna, who announced the verdict, stated, “Article 19 of the Indian Constitution is noble in his mind and remains a charter of brilliant rights in his promises. At the heart of the conflict, the state portal was launched in October 2023. The name means “help” in English, allowing authorities to issue orders directly on social networks.

X filed a lawsuit in March, saying Sahyog would act as a “censorship portal.” The platform said the system is not transparent and it goes against the spirit of freedom. However, the courts do not accept or endorse government laws to use Sahyog to eliminate illegal or harmful content.

Interestingly, it’s not just the companies that use Sahyog. Other major platforms like Google, Meta, Microsoft, LinkedIn, ShareChat, and more also respond to that order.
