Allahabad High Court gives a big blow to four teachers in teacher recruitment, takes a big decision

The Allahabad High Court has made a significant decision in a significant case related to teacher recruitment. The court has clarified that candidates applying for government recruitment must possess all the required documents by the deadline. The court stated that any candidate applying for a recruitment must possess all the required qualifications as required in the advertisement by the deadline. The court stated this.

This case was heard in a hearing in Uttar Pradesh. The matter relates to the recruitment of 69,000 assistant teachers. Explain this matter. Four teachers from Ballia filed a petition in the High Court regarding their appointment. The High Court heard the matter. In the petition, the petitioners stated that they participated in the recruitment process, passed the examination, and were subsequently appointed as assistant teachers. They argued that they had completed the required training and qualifications after their appointment and had been working as teachers for a long time.

The case revealed that the teachers’ BTC certificates were issued on August 7, 2019, while the deadline for applying for the recruitment was December 22, 2018. This means the required qualifications were obtained after the recruitment cutoff date. All of this was stated in the petition. The court heard the matter. The court stated that the deadline set in the advertisement is crucial for determining eligibility. Therefore, candidates must fulfill all mandatory educational and training requirements by that date, which will apply from the advertisement to the recruitment process.

Acceptance of Applications Does Not Proof of Eligibility

The petitioners also stated that their applications were accepted by the department. They were also given the opportunity to appear for the examination and subsequently appointed based on their selection. However, the court acknowledged that merely accepting an application or issuing an admit card does not guarantee that a candidate met all legal eligibility requirements. If a candidate has not met all the requirements, the appointment will be void. Therefore, the court ruled that all selection criteria must be met from the advertisement to the closing date.

Similarly, passing the exam and receiving an appointment does not remove the lack of basic eligibility. Meeting the required qualifications is a primary requirement in the recruitment process, and only then will it be considered.

What Was the Decision?

During the hearing of the petition filed by the four teachers, it was argued that they had served in the department for a considerable period after their appointment and had received their salaries. Therefore, it would not be appropriate to terminate their appointments. They argued that if the appointments were confirmed and they had served, how could this be done later?

The court did not consider this argument a basis for granting relief. The court indicated that appointments to government jobs must be made in accordance with the rules. If any rule is incomplete, the appointment will not be valid. If a candidate did not possess the required qualifications at the prescribed cutoff date, the appointment cannot be made valid based on the qualifications acquired later. Therefore, in this case, the appointment was also invalid.

The petitioners cited the relief received by some other candidates and demanded that they also receive relief, but the High Court rejected this argument. The court held that simply because someone else has received benefits contrary to the rules, it does not give them the right to repeat the same mistake.
